1. Introduction
This Privacy Policy describes how FlatFeeDIY (“we,” “us,” or “our”) collects, uses, shares and protects personal information when you visit our website, create an account, or use any of our services (the “Platform”). By using the Platform, you consent to the practices described here.
2. What information we collect
We collect the following categories of information:
- Account information: name, email, password (stored as a salted hash), phone number, and notification preferences.
- Listing information: property address, parcel data, price, photos, public and agent remarks, disclosures, showing instructions, and other data required by the MLS.
- Payment information: we use Stripe to process payments. Card numbers are submitted directly to Stripe and are not stored on our servers. We retain a tokenized reference, payment status, and amount.
- Communications: contact-form submissions, support emails, in-app messages and inquiry responses.
- Usage data: IP address, browser type, device identifiers, pages viewed, timestamps and referring URL, collected via standard server logs and analytics tools.
- Cookies and similar technologies: session cookies for authentication, anti-CSRF tokens, and optional analytics cookies.
3. How we use information
We use the information we collect to (a) create and operate your account; (b) place and manage your listing on the MLS through the Partner Broker; (c) process payments and prevent fraud; (d) respond to inquiries and provide support; (e) send transactional emails about your listing; (f) improve and secure the Platform; and (g) comply with legal obligations.
4. How we share information
We share personal information only as needed to operate the Platform and as described here:
- With Partner Brokers — we share your account and listing information with the licensed broker assigned to your state so they can place your listing on the MLS, perform required broker functions, and communicate with you.
- With the MLS & syndication portals — listing information (property data and photos) is, by design, distributed to the MLS, which redistributes the data to Zillow, Realtor.com, Trulia, Redfin and other portals. Do not include information in your listing that you are not comfortable being public.
- With service providers — payment processors (Stripe), email delivery services, hosting and security providers, photographers, sign vendors and similar contractors, in each case under a duty of confidentiality and only to the extent needed to perform their services.
- For legal compliance — we may disclose information to comply with subpoenas, court orders, law-enforcement requests, or to protect the rights, property or safety of FlatFeeDIY, our users or the public.
- Business transfers — if we are involved in a merger, acquisition or sale of all or part of our business, personal information may be transferred subject to the same protections as this Policy.
We do not sell personal information to third parties for advertising purposes.
5. Listings are public by nature
Real-estate listings are inherently public records. Once your listing is on the MLS, the listing data (address, price, photos, public remarks, disclosures required by your state) becomes available to MLS members, real-estate professionals and the public via the syndication portals. Information you submit in the agent-only remarks is shared with MLS-member agents but not the general public.
6. Cookies and tracking
We use essential session cookies to keep you signed in and to protect against cross-site request forgery (CSRF). We may use optional analytics cookies to measure aggregate use of the Platform. You can disable non-essential cookies via your browser settings; doing so will not prevent you from using core features of the Platform.
7. Data retention
We retain account information for as long as your account is open and for a reasonable period afterwards to satisfy legal, accounting and audit obligations. Listing data is retained for at least the length of the listing term plus seven years to comply with state and MLS record-keeping rules. Payment records are retained for at least seven years.
8. Security
We use technical and organizational measures appropriate to the sensitivity of the data we hold, including TLS encryption for data in transit, hashed passwords, scoped access for staff and Partner Brokers, and routine security review. No method of transmission or storage is 100% secure; we cannot guarantee absolute security and recommend you use a strong, unique password.
9. Your rights & choices
Subject to applicable law, you may have the right to (a) access the personal information we hold about you; (b) correct inaccurate information; (c) request deletion of personal information that is no longer needed for our legitimate purposes; (d) object to or restrict certain processing; and (e) export your data in a portable format. To exercise any of these rights, email contact@wasatchwebsites.net. We may ask you to verify your identity before responding.
California residents (CCPA / CPRA): you have additional rights regarding the categories of personal information we collect, sell or share. We do not sell personal information. To submit a verifiable consumer request, email contact@wasatchwebsites.net with “California Privacy Request” in the subject line.
10. Children
The Platform is not directed to children under 18 and we do not knowingly collect personal information from children. If we learn we have collected information from a child, we will delete it.
11. International users
The Platform is operated from the United States. If you access it from outside the U.S., you understand that your information will be processed in the United States, which may have data-protection laws different from those of your country.
12. Marketing emails
By creating an account, you consent to receive transactional emails about your listing, account and payments. We may also send occasional product or marketing emails; you can unsubscribe from marketing emails at any time using the link in the email or by updating your notification preferences in the dashboard. Transactional emails about an active listing cannot be opted out of while the listing is live.
13. Changes to this Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page and update the “Last updated” date. Material changes will be announced via the Platform and/or by email.
